Usher and his ex-wife will be bttling for custody of their children after the near death of their oldest son.

Usher Raymond V was hospitalized on Monday  after a pool accident.

The aunt tried to retrieve the boy but was not successful, according to USA Today. The nanny also went under water but failed to free the boy. The boy was then freed by two workmen in the house. This is a terrifying incident for Usher as it can be remembered that his stepson, 11-year-old Kile, died in a jet ski accident last year.

"My nephew was in the pool and he went in and I couldn't get him," Odin said to the 911 operator that was posted in TMZ. .  "I tried to get him. They got him and did CPR on him." A paramedic is in the background saying Usher's song "drowned but he's breathing now."

The boy is reporedtely doing better but the incident has opened old ounds between his parents.

The singer's son Usher V almost died under his watch which is why ex-wife Tameka-Raymond now wants sole custody of her children due to this pool accident.

According to Mirror UK, Raymond reportedtly filed court papers asking for an emergency hearing after the 5-year-old boy was hospitalized after the pool accident. Raymond also adds that the "Voice" coach is  "creating a dangerous environment" for his children."

In defense of the singer, his lawyer told reporters that Tameka is, "incapable of being a proper parent." He also said that Usher's ex-wife "does not have the emotional stability or capacity to bond with them, and therefore she is handicapped."
