Sean Kingston has been sued for $5 million by a fan.

The fan, Carissa Capeloto, claims that the singer, his bodyguard and another party gang raped her in 2010, according to Us Weekly.

The 23-year-old singer was cleared of any wrongdoing in the Seattle hotel incident after the authorities decided that the woman accusing Kingston and the others with rape was not a credible witness.

However, Capeloto is reopening the case by suing the Beat It singer for a minimum of $5 million. According to TMZ, she told the authorities that she was psychologically marred by the rape incidnent.

Capeloto, now 22 years old, claimed that in 2010 she was escorted to Kingston's hotel room for a meet-and-greet after the Justin Bieber concert. However, it went from good to ugly when the alleged rape occured.

Kingston has filed legal documents to  defend himself and is claiming that the sex was consensual. According to TMZ, Capeloto admitted in the papers that she had smoked pot as well having 7 to 10 shots of vodka prior to the meeting and claimed that she was "obviously intoxicated, incapable of consent."

The gang rape incident only stopped when a friend came to the room to help her and called the police. The trial for the case will happen this November.
