Halle Berry Custody Battle: Gabriel Aubry Reportedly Wins; Nahla Cannot Move To France

Halle Berry's custody battle with baby daddy Gabriel Aubry has been a highly publicized ordeal. Since getting engaged to Olivier Martinez, the "Cloud Atlas" actress has been petitioning to be allowed to move her and Aubry's four-year-old daughter to France. A Los Angeles judge has reportedly made a decision on the matter.

According to TMZ, Berry, 46, cannot permanently move her daughter, Nahla, to France. The actress had argued the move would put the youngster in a safer situation away from the paparazzi. However, France would also take Nahla away from her father, 36-year-old Aubry, who primarily works our of L.A.

Berry and Aubry split in 2010, and their relationship has been anything but amicable. Back in January, Aubry, a model and actor, was accused of pushing a nanny that was holding Nahla. Sources at the time told RadarOnline that Aubry and the nanny had engaged in a verbal altercation after he removed his daughter from school without telling the nanny. 

"She picked up Nahla to leave and Gabriel yelled at her and shoved her out the door so hard that she hit the wall -- while she had Nahla in her arms," a source claimed. 

Aubry denied the claims, but was taken to court by Berry who pushed to strip him of joint custody. He was not charged due to insufficient evidence.

Berry has been dating Martinez since 2010. The pair met on the set of "Dark Tide" and got engaged this past January.

Full details on the custody ruling have not been released.
