Bethenny Frankel and her estranged husband Jason Hoppy have been living together since their split in January of 2013, but now, the talk show host wants her former beau out and is requesting a judge evict him.

On Friday, Jan. 17, the former pair appeared together in a Manhattan court room where Frankel asked Supreme Court Justice Ellen Gesmer to remove Hoppy from their 3,400 sq-ft. Tribeca apartment.

"Avoiding eye contact with each other, Hoppy seemed happy while Frankel, who filed for divorce last January, seemed tense as she conferred with her lawyer," NY Daily News reported. "During the court appearance, Hoppy donned a conservative grey suit, while the former Real Housewives of New York star arrived wearing a short black leather skirt and high heels."

This court appearance comes just weeks after Frankel went public with a new man in Miami, Fla.

Over the New Year's holiday, Frankel and financier Michael Cerussi vacationed in South Beach where they celebrated the New Year together, allegedly with a kiss, and enjoyed some fun in the sun, according to E! News.

Unfortunately, the news of the blooming relationship hasn't sat well with Hoppy.

"He just can't understand why Bethenny has no problem parading men through Bryn's life at such a young age, especially since Bethenny complained her mother did the same thing when she was a child!" a source told Radar Online. "Jason had previously asked a judge to issue an order prohibiting Bethenny from having any of her boyfriends around Bryn. The judge denied Jason's request before, citing the fact that there was no evidence that begin around her mother's boyfriends harmed her."
